Terms of Service

1. Agreement

By using sparkcinder.com or purchasing any Cinder service, you agree to these terms. If you don't agree, please don't use the site.

2. Services

Cinder builds custom demos, apps, and full custom software. Specific scope, deliverables, and timelines are defined in a written proposal or checkout confirmation for each engagement.

3. Payment

  • Demo ($50) and Spark ($599) are paid in full at checkout.
  • Blaze ($3,500) may be split 50% at kickoff and 50% at launch.
  • Wildfire is billed monthly with a 3-month minimum, then month-to-month — cancel with 30 days' notice.
  • All fees are non-refundable once work has started, except where required by law.

4. Ownership & IP

On full payment, you own 100% of the custom source code we build for you. We retain rights to our pre-existing tools, libraries, and general know-how used to deliver the work.

5. Your responsibilities

You agree to provide accurate information, timely feedback, and any content, credentials, or access we need to deliver the work. Delays on your side may shift the timeline.

6. Acceptable use

You may not use our site or services to violate any law, infringe others' rights, distribute malware, or attempt to disrupt the service.

7. Warranty disclaimer

The site and services are provided "as is." We do not warrant that they will be uninterrupted, error-free, or fit for a particular purpose beyond what is agreed in your project scope.

8. Limitation of liability

To the maximum extent permitted by law, Cinder's total liability arising out of the services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate a project for material breach that is not cured within 15 days of written notice. You remain responsible for fees for work completed up to the termination date.

10. Governing law

These terms are governed by the laws of the jurisdiction in which Cinder is registered, without regard to conflict-of-laws principles.

11. Changes

We may update these terms. Continued use of the site after changes means you accept the updated version.
